The deceased was 39 years old at the time of his death. He was admitted to Perth Mental Health Unit following an acute manic episode and had recently taken methamphetamine. During his admission, John became increasingly agitated and aggressive, leading to the use of the prone physical restraint by staff members. During the restraint, John became unresponsive. The Coroner considered the supervision, treatment and care provided to John while he was a patient at Perth Mental Health Unit. The inquest explored whether the use of restraint was appropriate, whether adequate steps were taken to monitor John’s condition during the restraint and what changes have been implemented at the hospital since his death. It was noted that there were several communication breakdowns among the healthcare team members, including unclear documentation and handover procedures. Additionally, the involvement of John’s family in the care planning process was minimal, and they had not been notified of his detention under the Mental Health Act 2014 (WA). The Coroner found that John Smith died on 11 January at Perth General Hospital from positional asphyxia. Analyse the key legal and ethical issues identified in the coroner’s inquest?
